On October 10, 2017, the German Federal Constitutional Court (Bundesverfassungs- gericht) ruled that law makers in Germany must create new legislation which either scraps gender entries altogether or allows another “positive gender entry” (a third gender) into civil status law. The latter option is considered the most likely choice by many, with the possibility of a third gender of “inter/diverse”. Other countries have approached the issue before. But along with the positive aspect of legal recognition being gained through the addition of a third gender category, shortcomings in legislative developments can also be found.
